These Terms of Service (the "Terms") set out the conditions for using the online store "POMIII PARTAGE" and related services (the "Service") operated by POMIII LLC (the "Company"). By using the Service, you (the "User") are deemed to have agreed to these Terms.

Article 1 (Scope)

These Terms apply to all relationships between the User and the Company regarding the Service. The policies posted on our website (Shipping Policy, Refund Policy, Privacy Policy, etc.) also form part of these Terms.

Article 2 (Prohibited conduct)

Users must not engage in any of the following when using the Service:

  1. Acts that violate laws or public order and morals
  2. Providing false information, impersonation, or using fraudulent payment methods
  3. Infringing the copyright, trademark or other intellectual property rights of the Company or third parties

Article 3 (Formation of the sales contract)

  1. A sales contract is formed when the User places an order through the Service and the Company sends an order confirmation email.
  2. The Company may cancel or terminate the contract if the User:
    • Orders using false information or a fraudulent payment method
    • Fails to complete payment for the order
    • Has previously violated these Terms
    • Is otherwise deemed inappropriate by the Company

Article 4 (Returns, exchanges and cancellations)

  1. Returns, exchanges and cancellations for customer reasons are not accepted, except for defective or incorrectly shipped items.
  2. In the case of a defective or incorrect item, please contact us within 7 days of delivery. The Company will cover the return shipping cost and provide an exchange or refund.
  3. Details of returns and exchanges are governed by the Refund Policy, and cancellations of pre-order and made-to-order items by the Cancellation Policy.

Article 5 (Intellectual property)

The copyright and other intellectual property rights in the text, images, designs, logos and other content on the Service belong to the Company or their rightful owners. Unauthorized use, reproduction or redistribution is prohibited.

Article 6 (Disclaimer)

  1. Product images are made to resemble the actual items as closely as possible, but colors and textures may differ depending on your viewing environment.
  2. The Company is not liable when the supply of products becomes temporarily impossible due to natural disasters, system failures, carrier delays or similar causes.
  3. Except in cases of willful misconduct or gross negligence, the Company is not liable for any damages incurred by the User in connection with the use of the Service.

Article 7 (Changes to the Terms)

The Company may revise these Terms as necessary. Revised Terms take effect when posted on the Service.

Article 8 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the district court or summary court having jurisdiction over the Company's location, as the court of first instance.
